Situation: | This dispute concerned a very large waterfront multi storey residential development in London. The works were delayed due to complex matters including outside works in relation to incoming power, and other issues. Liquidated damages were deducted from the contractor in respect of the overrun and the contractor referred the matter to adjudication. |
Action: | A member of Probyn Miers was appointed as adjudicator. The adjudicator considered the submissions of the parties, met with them and gave his decision. |
Result: | A decision was issued in relation to the dispute. |
Client: | A London arts academy and a contractor |
Situation: | This dispute concerned an historic building in London which was being partly altered and refurbished whilst it remained occupied. The works involved complex alterations to mechanical and electrical services, including for rerouting of services through the historic structure. |
Action: | The parties fell in to dispute concerning the date of Practical Completion and the payment of additional preliminaries in relation to a period of extension of time. The contractor referred the matter to adjudication. |
Result: | An adjudicator’s decision was issued in relation to the dispute. |
Client: | International Communications company |
Situation: | The international communications company is constructing a new £750 million headquarters building in the UK. A member of Probyn Miers is the named adjudicator in this contract, named by the employer in advance of any disputes arising. |
Result: | No matters yet referred to adjudication in this project. |
